Principles of the processing of clients’ personal data in MimiConcept, s.r.o.
Dear clients,
In this document we wish to inform you about how we at MimiConcept, s.r.o. (hereinafter also as “we” or “our company”) process your personal data in connection with offering, negotiation, providing and managing MimoConcept products and services.
The objective of the Privacy Policy is to provide you with information about, in particular, what personal data are collected by us, how we handle the personal data, from what sources we obtain the data, for what purposes we use the data, to whom may the data be provided, where you can obtain information about your personal data processed by us, and what your individual rights are when it comes to protection of personal data.

1. General information
Our company is subject to a range of statutory obligations relating to the processing of clients’ personal data that we must perform especially with respect to the fulfilment of contractual obligations, safe use of our products or the exercise of public authority. In the light of this, we would not be able to provide our products and services without your personal data. Clients’ personal data are also processed by us beyond the scope of our legal obligations for the purpose client care and also to verify your trustworthiness and/or payment record for selected services and to contact you with targeted offers of our products and services. For this, we need your consent. If you decide not to give your consent in these cases, products or services provided by us may be restricted or otherwise modified depending on the scope of data that we are authorized to process. We will inform each client of the extent of the restrictions or modifications.
Unless expressly stated otherwise, all information provided herein also applies to the processing of personal data of prospective clients, i.e. persons with whom we have not yet entered into a contractual relationship but we are already in contact, or our former clients. The information provided herein shall apply, to a reasonable extent, to the processing of personal data of other persons in respect of whom our company has certain obligations or with whom our company is in direct contact even though there is no contractual relationship between us and such persons (e.g. representatives and contact persons of legal entities).
1.1. Principles of the processing of personal data
When processing your personal data, we recognize and respect personal data processing standards and adhere to the following principles in particular:
(a) Your personal data are at all times processed for purposes that are defined clearly and easy to understand, by specified means and only for a period necessary with respect to the processing purposes; we only process accurate personal data of clients and there are measures in place in our company that personal data processing fulfils the specified purposes and is necessary for the fulfilment of such purposes;
(b) we protect and process your personal data in a manner that ensures the highest possible security of such data and prevents any unauthorized or accidental access to, changes, destruction or loss, unauthorized transfer or any other unauthorized processing or any other misuse of clients’ personal data;
(c) we always inform you in a comprehensible manner of the processing of your personal data and of your rights and to accurate and complete information regarding the circumstances of such processing, as well as any other related rights you might have;
(d) In our company, we maintain appropriate technical and organizational measures to ensure the security level to cover all possible risks; all persons who come into contact with the personal data of our client are subject to the duty of non-disclosure for the information obtained in connection with personal data processing.
2. Information on the processing of personal data
2.1. Information regarding the controller

2.2. Purposes of processing and the legal basis for processing
2.2.1. Personal data processing without your consent
In general, these are situations when you are obliged to provide us with certain personal data as a condition to enable us to provide you with our product or service, or when we are entitled to process your personal data obtained by other means.
We are legally entitled to process your personal data without your consent for the following purposes in order to comply with our legal obligations, in particular for
(a)fulfilment of statutory obligations
(i) fulfilment of reporting obligations vis-à-vis official authorities;
(ii) fulfilment of obligations on clients’ identification and due diligence under the Anti-money Laundering Act;
(iii) compliance with archiving obligations;
(b) entering into or performance of a contract with you.
(c) protection of rights and legally protected interests, mainly for the resolution of any disputes, in particular for the purposes of litigation or other disputes.
2.2.2. Personal data processing with your consent
These are generally situations when you give voluntary consent to us for the processing of the personal data provided to us by you or otherwise obtained. If you do not provide your consent, this may result in our company being unable to provide certain products and services or being forced to make reasonable adjustments to the availability, scope or conditions relating to the products and services provided.
Based on your consent, our company processes your personal data for the following purposes:
(a) client care
These are activities that do not constitute the performance of contract or other legal framework of personal data processing and include the following activities:
(i) market research;
(ii) monitoring of clients’ behaviour on the website of our company in connection with the services offered (accordingly, this purpose does not refer to the mere obtaining of information on the behaviour of users visiting the website of our company through cookies, described below in the section Electronic means of communication and mobile applications);
(b) offers of products and services
This in particular includes the dissemination of information, offers of products and services of our company and other persons, including the offer of products and services specifically targeted at individual clients, via various channels, such as post, electronic means (including e-mail and messages sent to mobile devices using telephone numbers) or by telephone calls, through the website. More details are provided in this Policy below.
2.3. Scope of the processing of clients’ personal data
Our company processes your personal data to the extent necessary to fulfil the above-mentioned purposes. We process contact and identification data, data concerning trustworthiness and payment record, descriptive and other data and also data about other persons to the necessary and justified extent. More information on the scope of the processing of clients’ personal data is available in Annex No. 1 to this Policy.
Our company processes also:
Records of communication. Our company monitors and records selected communication with clients, especially telephone calls, through an independent Call Centre services provider. You will be notified in advance at all times if recordings are made. The content of such communication is confidential and is used by us for the fulfilment of legal obligations, entering into and performance of contracts, protection of rights and legally protected interest, and, with your consent, for client care purposes.
2.4. Manner of personal data processing
Your personal data are processed mainly by employees of our company and also third parties to a necessary extent (our shipping partners). Before your personal data are transferred to third parties, we as a rule conclude a written contract with that party, containing the same safeguards for the personal data processing as our company itself observes in accordance with its legal obligations, or we verify those parties’ compliance with the GDPR and applicable legal regulations regulating personal data protection.
2.5. Recipients of personal data
Your personal data are made accessible to employees of our company in connection with the performance of their work duties that require the handling of clients’ personal data, however, only to the extent necessary in the given case and in compliance with all security measures.
In addition, your personal data may be transferred to third parties engaged in the processing of personal data of our company’s clients, or, as appropriate, the personal data may be made available to them for other reasons according to the law.

In accordance with applicable legal regulations, our company is entitled, or directly and without your consent, obliged to transfer your personal data to: Competent state authorities, courts and law enforcement authorities for the purpose of fulfilment of their obligations and for the purpose of enforcing decisions; Payment services providers where necessary for the reason of prevention, investigation or detection of frauds in the area of payment transactions; Providers of consumer and other credits, for the purposes of performance of contracts; Insurance and reinsurance providers, for the purpose of performance of contracts; Other persons to the extent required by legal regulations, e.g., third parties for the purpose of recovering our claims from clients. 2.5.2. With your consent, on the basis of which we are entitled to handle your personal data to the respective extent, your personal data may be transferred also to entities for the purpose of compliance with legal regulations of our company, conclusion and performance of contracts, offering products and services, protection of rights and legally protected interests of our company, client care. 2.6. Transfer of personal data abroadYour personal data are processed in the Czech Republic and in other European Union member states or outside the European Union, where entities such as our suppliers, processors and partners (e.g. Apple) are seated, and which share the same data protection standards as the Czech Republic or members of the European Economic Area. 2.7. Period of the processing of personal dataOur company processes clients’ personal data only for a period necessary with the view of the purposes of the processing of such data. We assess on a continuous basis whether there still exists a need to process certain personal data needed for a certain purpose. Where it is determined by us that the data are no longer necessary for any of the purposes for which they have been processed, the data will be destroyed. However, internally, we have already assessed, in relation to certain purposes of personal data processing, a normal useful life of personal data, at the end of which we evaluate with much care the need to process the relevant data for this purpose. In this connection, personal data processed for the purposes of: (a) performance of contract are processed for the duration of the contractual relationship with the client; in addition, the relevant personal data are generally usable for a ten-year period; 2.8. The right to withdraw consentThis Policy explains why we need your personal data and that we may process your personal data for certain purposes only with your consent. You are not obliged to give consent for us to process your personal data and you have a right to withdraw your consent. Please remember that we are entitled to process certain personal data for certain purposes also without your consent. If, in such case, you withdraw your consent, we will no longer process the appropriate personal data for the purposes requiring the relevant consent, but we may be entitled or even obliged to continue to process the same personal data for other purposes. Your right to request access to personal data and protection of clients’ rightsIf you ask us for information regarding the processing of your personal data, we will provide you with all information as to what data are processed by us about you. For the provision of such information, we are entitled to request a reasonable reimbursement for costs expended in this connection. If you discover or believe that our company or a third party involved in the data processing performs the processing of your personal data in breach with the protection of your private life or the law, in particular, if your personal data are inaccurate, you may: (a) request an explanation from our company or the third party involved in the data processing; As a client, you at all times have a right to contact the Office for Personal Data Protection. 3. Electronic means of communication and mobile applicationsAs part of our client care, our company develops technology to enable you to enjoy modern electronic means of communication and mobile applications when using our products. This in particular includes services related to the use of the Internet, social networks and various mobile applications. Social networks. You may contact us also via various social networks. We use these communication channels mainly as marketing tools and currently, these networks do not serve for provision of our products and services. Cookies. On providing our products and services, we use cookies, i.e., small text files placed on the user’s computer when the website is first loaded. These files help us identify more easily the manner in which the visitors work with the content of our website. These findings facilitate our communication with visitors of our website or help us target our marketing more effectively. Please visit our website for more information about cookies. 5. The PolicyThis Policy is valid and effective as of 23.05.2018. The text of the Policy is posted on our company’s website. Annex No. 1 – Scope of the personal data processedIdentification data - including in particular, the name, surname, permanent residence address, type, number and validity of identity document; for clients who are business natural persons - also ID No. and Tax ID No. Other possible identification data include for example the IP address of the computer used and sets of specific authentication data that we agree to use. Contact data – name, surname, contact address, telephone number, e-mail address or other similar contact data. Other possible identification data include for example the IP address of the computer used and sets of specific authentication data that we agree to use. If you withdraw a submitted request for a product or service, we will process the date of withdrawal of the request in addition to the data provided to you before the withdrawal. Data arising from the performance of obligations from contracts - depending on the nature of the product or service provided, we process data related to the product or service provided. In this category, processing takes place with respect to such personal data as the duration of the contract, duration of the guarantee, serial number of the equipment. Personal data obtained in connection with the provision of our products and services - these are personal data collected during our interactions and include especially: Personal data generated by our activities - these are especially numbers allocated by us to clients/products, data created by the evaluation of your transaction-based behaviour or data provided by you (e.g. for determining whether the conditions for applying for a fee discount have been met), evaluation of a submitted request for products or services or any evaluation necessary for our decision whether or not to offer you a product or service. |
